1. When is municipal court held?

Municipal court is held the 2nd, 3rd ,and 4th Thursday of each month.

The trial docket is held the 2nd Tuesday of each month.

2. Where is your office located?

Our court office is located at the corner of North Hanley and Airport road. Take 170 North to the Airport Rd exit and go right the next intersection is North Hanley and Airport Rd. The City Hall Building is located to the right of the intersection. More...

3. Does your court accept faxed entries from attorneys?

No, our court office does not accept faxed entries. We will allow you to mail your entry on the court date without assessing any extra fees on your client's case.

4. Can I get an continuance for my court date?

Yes, one will be granted for the intial court date and that can be obtained at the court office without an appearance.

5. What time is attorney's call?

Attorney's call is at 5:30pm.

6. When will I receive my recommendation from the prosecutor?

Recommendations are mailed two-three weeks after the intial court date.

7. What time does court start?

Court starts at 6:00pm and doors open at 5:30pm.

8. What are your methods of payment?

The court office accepts money order's, cashier's check, debit/credit and some cases can be paid online.

In court we accept cash, check, and debit/credit cards.

1. What are the hours of operation for the Inspections Department

The Permit office is open from 8:30AM to 5:00 PM, Monday through Friday. Field Inspectors work from 8:30 AM to 5:00 PM Monday to Friday and are typically in the office until 9:00 AM daily. Telephone (314) 524-3313.

Any person residing in a property within the City of Berkeley

3. When is an Occupancy Permit Required?

Before a person is allowed to move into a property, located in the City of Berkeley, the property must be inspected by a City of Berkeley Inspector. The cost of the Occupancy Inspection is Seventy-Five Dollars ($75.00). The Inspection can be ordered at the Inspections department of the City of Berkeley. The inspection will then be performed within 24 - 48 hours. NOTE: The Inspection MUST be ordered by the Property Owner. IF the property owner is not able to order his inspection, then a notorized letter must be presented stating who is authorized to order inspections, and transact other business pertaining to the property, on behalf of the owner.

* Once the property has passed inspection, the compliance is valid for Thirty Days (30). Once the compliance expires the owner is required to obtain a new inspection.

* The next step is to obtain an OCCUPANCY PERMIT. The occupancy permit can be obtained at the Inspections Department of the City of Berkeley. This Occupancy Permit must be obtained BEFORE anyone moves into the property.

*The Cost of the permit is Forty Dollars ($40.00) for Owner Occupied residents.

*The following Documents are needed to show proof of ownership: a current Copy of a Deed of Trust (obtained from St. Louis County) OR Copy of the HUD Statement (located in your closing documents) AND a valid drivers license/Identification card.

*The following items are needed before a tenent moves into a rental property;Twenty dollars ($20.00) for your occupancy permit AND a Landlord Authorization Form from your Landlord, AND A valid Drivers License/ Identification Card

4. How can I add , change , or delete a persons name from my Occupancy Permit?

If the change {add, change, delete} is to be performed by an owner/occupant, then the owner needs to present their valid identification and a fee of Twenty-Five Dollars ($25.00)
If the person requesting the change is a tenant, then the tenant must bring a signed Landlord Authorzation Form and then , and only then, will the changes be made. Again, a Twenty-Five Dollars ($25.00) fee will be charged for making the changes.

5. Does Berkeley have a ban on any dogs?

The Following dogs are banned and may not be kept within the City of Berkeley, Missouri:
{unless there is proof that the dog was in the City of Berkeley before February 7, 2005}

Section 1. Certain Dogs Prohibited. the following dogs may not be kept within the City of Berkeley, MO:

1. Any "pit bull dog" being defined to mean:

(a) The Bull Terrier breed of dog

(b) The Staffordshire Bull Terrierbreed of dog

(c) The American Staffordshire Terrier breed of dog

(d) The American Pit Bull Terrier breed of dog

(e) Dogs of mixed breed or other breeds than listed above which breed is mixed breed is known as pit bulls, pit bull dogs or pitbull terrier; or

(f) Any dog which has the appearance and characteristics of being predominantly of the breeds of Bull Terrier, Staffordshire Bull Terrier, Amierican Pit Bull Terrier, American Staffordshire Terrier, any other breeds commonly known as pit bulls, pit bull dogs or pit bull terriers, or a combination of any of these breeds.

2. Rottweiler breed, including dogs of mixed breed and any dog which has the appearance and characteristics of being predominantly of the Rottweiler breed.

Section 2. Punishment. the owner or keeper of any of the above defined dogs found within the city limits of the City of Berkeley may be punished by a fine of up to One Thousand Dollars ($1,000.00) AND may be jailed for up to Ninety (90) days OR BOTH. Additionally, the dog or dogs shall be immediately confiscated by the Animal Control Officer of the City, If a violation of this Ordinance continues, each day's violation shall be deemed a separate violation.

6. When is a building permit required?

Generally, a permit is required for any work other than painting, flooring, cabinets and trim work on a home. Please call the inspection department to verify the work being done either does or does not require a permit.

7. As a homeowner, can I pull the building permit?

No, the City of Berkeley requires that if the homeowner is having a contractor do the work, the contractor should take out the permit, especially those requiring a licensed contractor, such as Mechanical, Electrical and Plumbing work. Licensed contractors are responsible for any code problems associated with the project.

8. Do I need a permit for a fence?

Yes, a fence permit is required. Submit a fence permit application, site plan and a description of the fence. The fence review takes about 7-10 days.

9. When is a Plot Plan or New Survey required?

As a rule, any time that the "footprint" of a primary or accessory building changes, a new plot plan and as-built survey are required. This includes decks, porches, and storage buildings. However, staff does have the authority to waive the survey if the construction is obviously not in the proximity of any setbacks or easements. Modifications inside the existing building shell do not require a plot plan or survey.

10. My neighbor and I are having a dispute regarding the boundary line of our properties. Who can I call in City Hall to help me?

Boundary disputes are personal legal matters and are not within the jurisdiction of the municipality (Note: Unless a municipal boundary is the subject of the problem). You should consult an attorney or your title company to assist you.

11. Can you recommend a carpenter or home improvement person to me so that I can have some property maintenance or property repairs performed?

No. We cannot recommend anyone to you. You should exercise due diligence and always request references from your contractor. Check the Better Business Bureau (BBB) before signing any contract with your contractor.
